Kim Kardashian has won $2.8M from the fast fashion company Missguided in a lawsuit claiming the company used her “person and trademarks” to sell replicas of her outfits.
Fast fashion company Missguided is known for selling replicas of the trendiest outfits. Now they will also be known for being the company that paid nearly $3M in damages to Kim K. and potentially opened a new chapter in trademark laws for social media platforms.
To gain momentum and increase (organic) reach, Missguided regularly tagged Kim Kardashian on their Instagram posts.
But, despite awarding $2.7M in damages and $59,600 in attorney fees to the plaintiff, no legal precedent one the violation of trademarks on social media was made. Missguided never responded to the lawsuit, leading to a loss. Missguided was also ordered to cease using Kardashian West’s trademarks in connection with the “sale, marketing, or distribution of its products.”
It’s unclear whether this judgement could be the beginning of yet another battle platforms will have to fight against.
